Terms of Service

These terms form an agreement between you and Artiswap Markets (“Artiswap”, “we”, “us”). They apply whenever you browse the site, buy a licence or physical product, or sell as an artist. By using Artiswap you accept these terms.

1. Who we are and what Artiswap does

Artiswap is an online marketplace for AI-assisted music, related creative intellectual property, and collaborative physical products. Artists list works and set prices; buyers licence those works or buy products that include them.

Artiswap is the marketplace operator and payment agent. Except where we are expressly the seller, contracts of sale for a listing are between the buyer and the artist who listed it.

2. Accounts

  • You must be at least 18 years old, or have consent from a parent or guardian.
  • You are responsible for the accuracy of your account details and for keeping your credentials secure.
  • You must not create accounts to evade suspension, manipulate ratings, or misrepresent who you are.
  • We may suspend or close an account that breaches these terms or that we reasonably believe is being used unlawfully.

3. Buying and licences

Each listing states the licence tiers available. The exact terms of the tier you purchase are snapshotted at the moment payment clears and stored with your order, so later changes to our standard wording do not alter what you already licensed.

  • Licences are granted worldwide and perpetually from the issue date and cannot be revoked by the artist once payment has cleared.
  • An Exclusive Rights Transfer (Buyout) assigns the artist's rights in the work to the buyer to the extent copyright subsists, otherwise grants an exclusive perpetual licence, and withdraws the work from further sale on Artiswap.
  • AI-use disclosures and AI Music Identification Codes are supplied and self-declared by the artist. Artiswap does not independently verify them and gives no warranty as to their accuracy.
  • Master files remain downloadable from your dashboard even if the artist later edits or unpublishes the listing.
  • Add-on music attached to a physical product is supplied under a personal-use licence unless the listing says otherwise.

4. Prices, payment, GST and shipping

  • Prices are displayed in Australian dollars (AUD) unless stated otherwise.
  • Payments are processed by Stripe. We never receive or store your full card details.
  • Where GST applies, tax is calculated at checkout and shown before you pay.
  • Shipping charges for physical products are shown at checkout and are set by the platform or by the artist for their own listings.

5. Digital goods, refunds and consumer rights

Because licences and master files are delivered immediately, digital purchases are generally not refundable once the files have been made available to you. Nothing in these terms excludes rights you have under the Australian Consumer Law, including remedies where a product or service is faulty, misdescribed or not delivered.

If something is wrong with an order, raise a ticket from your dashboard or on the support page within 30 days of purchase and our team will review it.

6. Selling on Artiswap

  • You may only list works you own or are authorised to license, and your AI-use disclosure (including any AI Music Identification Code) must be accurate.
  • You must not list unlawful, infringing, hateful, or sexually exploitative material, or content that impersonates a real person's voice or likeness without permission.
  • You are responsible for fulfilling physical orders you accept, and for the accuracy of your descriptions, stock and delivery timeframes.
  • We may decline, unpublish or delist a listing that breaches these terms or the law.

7. Commission, balances and payouts

  • Artiswap deducts a platform commission from each sale. The rate in force, including any rate individually negotiated with you, is shown in your seller dashboard.
  • Shipping charges collected from buyers are passed through to the seller in full and are not commissioned.
  • Sale proceeds are subject to a cooling-off hold before they become available to withdraw.
  • Sellers request withdrawals from their dashboard once the minimum threshold is met. We may withhold a payout while an order is disputed, suspected of fraud, or under review.
  • Sellers are responsible for their own tax obligations on amounts they receive.

8. AI-generated content

Some works and personalised songs on Artiswap are produced with generative AI tools. Outputs may vary in quality and are supplied on the basis described in the listing. Where a buyer commissions a personalised song, the number of generations included is stated in the order, and the final confirmed version is the one licensed and registered.

Copyright law in Australia and in many other countries requires human authorship. A work that is wholly machine-generated may therefore attract no copyright protection at all. Buyers should assume this risk exists for any AI-generated listing, and should obtain their own legal advice for their intended use.

For this reason an Exclusive Rights Transfer (Buyout) operates as: an assignment of copyright to the extent copyright subsists in the work; and, where it does not, an exclusive, perpetual and irrevocable licence together with the artist's covenant not to license the work to anyone else.

Artists are solely responsible for their AI-use disclosures, for the accuracy of any AI Music Identification Code (ISRC-AAM-CID) they register, and for holding the commercial rights required by the AI tools they used. Artiswap presents these disclosures as declared and registered by the artist; we do not independently verify or certify them.

9. Acceptable use

  • Do not scrape, resell, or bulk-download listings, previews, or master files.
  • Do not attempt to bypass paywalls, licence limits, or platform security.
  • Do not post reviews, enquiries, or support tickets that are abusive, misleading, or written to manipulate a seller's standing.

10. Our intellectual property

The Artiswap name, branding, site design, and software are owned by Artiswap Markets. Nothing in these terms transfers those rights to you.

11. Disputes and support

All buyer, artist and order issues are handled through support tickets. Our team reviews each ticket and may mediate between a buyer and an artist, including issuing a refund or withholding a payout where we consider it appropriate.

12. Liability

To the extent permitted by law, Artiswap is not liable for indirect or consequential loss, lost profits, or loss of data, and our total liability for any claim relating to an order is limited to the amount you paid for that order. This does not limit liability that cannot lawfully be excluded.

13. Changes and governing law

We may update these terms; the “last updated” date above reflects the current version, and material changes will be announced in the product. These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
